1). Criminal Court Milan

On 4 July 2024, the Court of Appeal of Milan issued its decision in the ongoing proceedings against Marco Giorgi and Igor Akhmerov, amongst others. The court upheld the convictions of Akhmerov and Giorgi for indictment counts B) and D) against the State of Italy, but overturned their convictions under indictment count F) in relation to EAM.

On 11 October 2024, EAM submitted an appeal to the Supreme Court of Cassation asking it to once again set aside the judgement from the appeal court. The grounds for this appeal can be read in previous stock exchange notices. Aveleos, Avelar, SAEM, Akhmerov, Giorgi and Sebastiano Maggi have also decided to appeal. No determinations have yet been made by the Court of Cassation as to timelines or hearing dates.

2). UBI Banca Case in Brescia
On 3 December 2024, the final hearing took place in the matter against UBI Banca, now Intesa Sanpaolo, in the court of Brescia. A decision is expected in the coming weeks.

3). ENFO 25
Earlier this year EAM applied under the amnesty scheme for a reinstatement of ENFO 25’s Feed-in Tariff. The GSE accepted this application on 11 October 2024. The Feed-in Tariff was restored in early December 2024.

On 14 December 2024 EAM was informed by GSE of a reimbursement representing the discounted pay-back for the period of time in which the tariff was suspended. A payment is expected within the next month.

Den 4. juli 2024 avsa lagmannsretten i Milano sin avgjørelse i den pågående kriminalsaken mot blant andre Marco Giorgi og Igor Akhmerov. Retten opprettholdt skyldig dom av Akhmerov og Giorgi for tiltalepunktene B) og D) mot staten Italia, men opphevet skyld under tiltalepunkt F) i forhold til EAM.

oktober 2024 leverte EAM inn ny anke til Høyesterett og ba retten om igjen å oppheve dommen fra lagmannsretten. Begrunnelsen for denne anken kan leses i tidligere børsmeldinger. Aveleos, Avelar, SAEM, Akhmerov, Giorgi og Sebastiano Maggi har anket sine respektive dommer. Det er ennå ikke tatt noen avgjørelser av Høyesterett med hensyn til tidslinjer eller høringsdatoer.

2). UBI Banca sak i Brescia
3. desember 2024 fant siste høringen sted i saken startet av UBI Banca, nå Intesa Sanpaolo, i retten i Brescia. En avgjørelse er ventet i løpet av de kommende ukene.

3). ENFO 25
Tidligere i år søkte EAM under amnestiordningen om å få gjeninnført ENFO 25s “feed-in tariff”. GSE godtok denne søknaden 11. oktober 2024. “feed-in tariffen” ble gjenopprettet tidlig i desember 2024.

Den 14. desember 2024 ble EAM informert av GSE om refusjon som representerer den rabatterte tilbakebetalingen for perioden da tariffen ble suspendert. En betaling forventes i løpet av neste måned.

Has EAM contested the interim relief granted to Akhmerov? In my view → you can claim legal expenses ONLY in the SAME case in which you have incurred them, i.e. you can’t sue them separately. In this respect I was surprised that Norwegian court has granted interim relief to Putin’s crony (not to mention that it was granted against Norwegian company majority shareholders of which are Norwegian citizens)!

Negative decision for EAM in the Brescia Case v UBI Bank

On 3 December 2024, the final hearing took place in the matter between UBI Banca (now Intesa Sanpaolo) and EAM.

EAM was informed today, 8 January 2025, that a judgement had been entered in this case. The Judge found in favor of UBI and has ordered EAM to pay an amount of approximately EUR 5,8 million. The court’s decision may be appealed.

The judge found that even though UBI was the legal owner of the plants at the time the fraudulent applications for accessing the Feed-in tariffs were made, it was the SPVs, not UBI, who had the responsibility to confirm the plants’ completion. Further, the termination, by GSE, of the Feed-in Tariff contracts and the SPVs’ subsequent insolvencies were not deemed to be sufficient to relieve EAM of its duty to keep the SPVs financially alive and to prevent them from going into bankruptcy.

UBI leasing was acknowledged by the appeal court of Milan in the criminal proceedings decision published the 4th of July 2024, where EAM is a party, as victim of fraud.

EAM’s legal counsel has provided a list of possible grounds for appealing this judgement and EAM intends to appeal within the next 30 days. EAM will publish more information as soon as possible.

Negativ avgjørelse for EAM i Brescia-saken mot UBI Bank

desember 2024 fant den siste høringen sted i saken mellom UBI Banca (nå Intesa Sanpaolo) og EAM.

EAM ble informert i dag, 8 januar 2025, om at det var avsagt dom i saken. Dommeren fant i favør av UBI og har pålagt EAM å betale et beløp på ca. EUR 5,8 millioner. Rettens avgjørelse kan ankes.

Dommeren fant at selv om UBI var den juridiske eieren av anleggene på det tidspunktet de falske søknadene om tilgang til subsidier ble fremsatt, var det SPV-ene, ikke UBI, som hadde ansvaret for å bekrefte anleggenes ferdigstillelse. Videre ble GSEs oppsigelse av subsidiene og SPV-enes påfølgende insolvens ikke ansett for å være tilstrekkelig til å frita EAM fra sin plikt til å holde SPV-ene økonomisk i live og forhindre at de gikk konkurs.

UBI-leasing ble den 4. juli 2024 anerkjent av ankedomstolen i Milano som offer for bedrageri straffesaken hvor EAM er part.

EAMs juridiske rådgiver har gitt en liste over mulige grunner for å anke denne dommen, og EAM har til hensikt å anke i løpet av de neste 30 dagene. EAM vil publisere mer fyllestgjørende informasjon så snart som mulig.
