Call ended - Major Takeaways:
-
Arbitration if needed would take place at a court in Washington (I believe it was the ICSID : https://en.wikipedia.org/.../International_Centre_for…)
-
The termination notice has not been given yet
-
In event of termination notice, the contract allows for a cure period to remedy the breach (likely like the ERIN agreement). African Petroleum presented an offer to go into the 1st drilling phase to the old government before the expiration of the current phase, but was not able to settle then because mostly all ministers were put in jail under Jammah, and because of the presidential election (One could call this force majeure in legal terms).
The new president was presented with this offer again at the meeting between Adama Barrow & APCl immediately after his inauguration - and thus APCL believes that a “cure for breach” has allready been presented prior to the breach taking effect as of september last year.
-
There have been several meetings during 2017, first one with Adama Barrow in february, after that April & May, all were had in a “good tone” & APCL management is very suprised with the turn of events as an outcome of the media from Reuters
-
The APCL mgt. has a meeting with Fafa Sanyang (Minister of Energy and Petroleum) later toonight, in order to understand more about the situation.
